Property Deeds and Land Titles
In Thailand, property deeds and land titles are crucial legal documents that define ownership rights over land and real estate. A land title deed is issued by the Thai government and provides proof of legal ownership. It's important to understand the different types of land titles and their implications when buying, selling, or transferring property:
Chanote (Nor Sor 4 Jor)
The Chanote is the most secure and definitive land title in Thailand, offering full ownership rights and is recognized as the most desirable title. With a Chanote, the landowner has the legal ability to sell, transfer, or mortgage the property without restrictions. This title is typically issued for urban or developed land and is accompanied by clear demarcation on a certified map.
Nor Sor 3 Gor
A Nor Sor 3 Gor title represents confirmed possession rights, officially surveyed by aerial photograph rather than GPS. It can be sold, mortgaged, or transferred much like a Chanote, and can also be upgraded to one after meeting specific legal requirements set by the Land Department. This land type is often found in rural areas.
Nor Sor 3
The Nor Sor 3 land title confirms possession rights, but the boundaries are surveyed less precisely than a Nor Sor 3 Gor or Chanote. It can still be sold, mortgaged, or transferred, though a sale requires a 30-day public notice period first. This title is often used for agricultural or undeveloped land.
Sor Kor 1
A Sor Kor 1 certificate is a notification of possession, not a title of ownership, and offers very limited legal recognition. It cannot be used for secure transfers, sales, or property development unless upgraded to a Nor Sor 3 or Chanote. The Land Department stopped issuing new Sor Kor 1 certificates in 1972, so any that exist today are historical and may be eligible for upgrading depending on the land's location.

Common Property and Land Title Mistakes

-
Assuming a lower-tier title offers the same security as a Chanote
Nor Sor 3 and Sor Kor 1 titles carry real differences in survey precision and legal protection. Understanding exactly what a title does and doesn't guarantee matters before you commit to a purchase.
-
Skipping title due diligence
Buying without checking for existing liens, encumbrances, or disputes is one of the most common and costly mistakes in a Thai property purchase.
-
Wiring funds directly to the seller before title transfer is confirmed
Paying before the transfer is registered leaves you with little recourse if something goes wrong. Using escrow or a client account protects both sides.
-
Underestimating transfer taxes and fees
Transfer fees, specific business tax, and withholding tax can add up, and the amount depends on how long the seller has owned the property. Budget for this before you negotiate a price.
-
Not accounting for the notice period on a Nor Sor 3 sale
A Nor Sor 3 sale requires a 30-day public notice period before it can complete. Not factoring this into your timeline can delay a transaction unexpectedly.
-
Assuming Sor Kor 1 land can be mortgaged or developed
A Sor Kor 1 certificate offers very limited legal recognition and generally can't be used for secure transfers, sales, or development until upgraded.

FAQs
What's the difference between a Chanote and other land titles?
A Chanote offers full ownership rights with precisely surveyed boundaries. Other titles, like Nor Sor 3 Gor, Nor Sor 3, and Sor Kor 1, offer varying degrees of possession rights and survey accuracy, and some can be upgraded toward a Chanote over time.
Who pays the transfer taxes and fees, the buyer or the seller?
The 2% transfer fee is typically split between both parties, though this is negotiable rather than required by law. The seller is generally responsible for specific business tax or stamp duty, and for withholding tax.
Can I upgrade a lower-tier title to a Chanote?
In many cases, yes. Nor Sor 3 and Nor Sor 3 Gor titles can often be upgraded after meeting requirements set by the Land Department, though the process and eligibility depend on the specific land.
What happens if there's a dispute over land boundaries?
This is more likely with titles like Nor Sor 3, where boundaries aren't precisely surveyed. We can assist with resolving boundary disputes and, where appropriate, formalizing more accurate boundaries through the Land Department.
Is it safe to pay for property directly to the seller?
We'd recommend against it. Using escrow or a client account protects both sides by ensuring funds aren't released until the transfer is properly registered.
How long does a property transfer take to register?
It varies depending on the title type and whether any additional steps, like a Nor Sor 3's notice period, apply. We'll give you a realistic timeline specific to your transaction.
