TYPES OF POA

Power of Attorney Categories

General Power of Attorney

A General Power of Attorney provides a trusted individual with broad authority to manage multiple aspects of your personal, legal, and financial affairs. This type of POA is ideal when you need someone to handle a wide range of responsibilities on your behalf, such as overseeing business operations, managing bank accounts, signing documents, or even representing you in legal matters.

Specific Power of Attorney

A Specific Power of Attorney authorizes someone to act on your behalf for a particular action, like signing a real estate contract or representing you in a legal matter. It's useful for one-time transactions, allowing focused authority without broad access, and is commonly used when specific, immediate tasks require delegation.

Types of Power Of Attorney (POA)

    01

    Legal capacity

Both the Principal granting authority and the Attorney-in-Fact acting on their behalf must have the legal capacity to carry out the actions specified in the POA.

    02

    Legal Formalities

A POA must be in writing and signed by the Principal, and in some cases witnessed, particularly when executed abroad for use in Thailand.

    03

    Notarization

Property transactions in particular often require notarization, including the Principal's certified identification with duty stamps, especially when submitted to a local Land Office.

    04

    Thai Government Agency Requirements

Some agencies require their own standard forms rather than a general POA. Land transactions use form Tor Dor 21, and condo transfers use Or Chor 21, both limited in scope and validity to that specific transaction.

    05

    Validity Period

There's no single statutory limit on how long a POA remains valid. Land Offices commonly expect one signed within the last 3 months for property transactions and may reject older documents at their discretion. For other purposes, a POA generally remains valid until revoked or until the task it covers is complete.

Apostilles and Document Authentication

For international use, documents signed under a POA typically require either an apostille or full legalization to be recognized abroad, depending on the destination country. Thailand itself acceded to the Apostille Convention in June 2026, but this only takes effect from 28 February 2027. Until then, Thai documents, including powers of attorney, still require consular legalization rather than a simple apostille, so it's worth planning for that longer process in the meantime.

Professional Notary Public For Authorization

Many Powers of Attorney, particularly those for property transactions or use abroad, need to be professionally notarized before they're accepted. A Notarial Services Attorney, Thailand's equivalent to a notary public, verifies your identity, witnesses the signing, and certifies the document so it meets the standard required by banks, the Land Office, or foreign authorities.

Common mistakes and reasons for rejection

  1. Using a general POA for a Land Office transaction

Land Offices often reject broad, general POAs for property matters and expect their own specific form instead, such as Tor Dor 21 or Or Chor 21.

  2. Letting the POA go stale before using it

Land Offices commonly expect a POA signed within the last 3 months for property matters, and may reject an older one at their discretion, even if it's still technically valid.

  3. Signing abroad without notarization and embassy legalization

A POA signed outside Thailand needs both notarization and legalization by the Thai Embassy or Consulate before it's accepted here. Skipping either step means starting over.

  4. Inconsistent handwriting, ink, or unexplained alterations

Thai authorities expect a single handwriting and ink throughout the document. Any addition, deletion, or change needs to be noted and signed, or the POA risks rejection.

  5. Overlooking stamp duty

A POA without the correct stamp duty affixed can be rejected outright, or need correction at the Land Office before it's accepted.

FAQs

How long is a Power of Attorney valid for?

There's no single statutory limit, but Land Offices commonly expect a POA signed within the last 3 months for property transactions and may reject an older one at their discretion. For other purposes, a POA typically remains valid until revoked or the task is complete.

Does a POA signed outside Thailand need anything extra before I can use it here?

Yes. It generally needs both notarization and legalization by the Thai Embassy or Consulate before Thai authorities will accept it.

What's the difference between a General and Specific POA?

A General POA gives broad authority across multiple matters, while a Specific POA is limited to a single transaction or task. Land Offices in particular often expect a Specific POA, or their own government form, rather than a broad general one.

Is there a specific form I need for property or condo transactions?

Yes. Land transactions use form Tor Dor 21, and condo transfers use Or Chor 21, both limited in scope to that specific transaction.

When will apostilles actually be usable for documents going to or from Thailand?

From 28 February 2027 onward. Before that date, consular legalization remains the correct process, regardless of Thailand's accession to the Convention.
