Wills And Estate Planning - Attori Law

Wills and Estate Planning Secured

Without a will, your estate is distributed under Thai intestacy rules; rarely the outcome you would have chosen. We draft Thai wills for foreign nationals and residents, advise on cross-border estates, and handle probate when the time comes. The right people inherit what you intended, with no avoidable complications for those you leave behind.

SECURE YOUR LEGACY

Wills and Estate Planning

Planning for the future protects your assets and ensures your loved ones are provided for according to your wishes, not according to Thailand's default succession rules. Our estate planning services guide you through drafting a legally valid Thai will, establishing powers of attorney, and structuring your estate in line with Thai law.

What Is Estate Planning?

Estate planning means putting a structured plan in place for how your assets are managed, your tax obligations are met, and your wishes are actually carried out, rather than left to Thailand's statutory rules for someone who dies without a valid will. In Thailand, this typically includes:

Wills for clear asset distribution.

Foundations for ongoing management and privacy.

Living Wills and Healthcare Directives for personal healthcare decisions.

Lasting Powers of Attorney (LPA) for appointing trusted representatives.

Each of these elements helps provide financial security for your loved ones and ensures that your legacy is protected, even across borders.

Appointment of Executor

The executor is responsible for managing your estate after your passing, ensuring your instructions are carried out. Selecting someone trustworthy and capable is crucial.

Asset Allocation and Bequests

Specify how assets such as property, savings, and valuables should be distributed among beneficiaries, ensuring each receives their intended share.

Witness Support

Two witnesses must be present at the time of signing to ensure legal validity.

Debts and Liabilities

Benefits of Strong Wills and Proper Planning

    01

    Full Control Over Who Inherits

Thailand doesn't impose forced heirship, so a valid will lets you decide exactly who receives your assets, rather than defaulting to the statutory order set out in the Civil and Commercial Code.

    02

Protects partners who aren't legally married

Thai intestate succession doesn't recognize cohabiting partners at all. Without a will, an unmarried partner can be left with nothing, no matter how long you've been together.

    03

A faster, more straightforward probate process

Naming an executor in your will avoids the delays of the court appointing one for you, which can add months to settling an estate.

    04

Reduces the risk of disputes among heirs

Clear, documented wishes leave less room for statutory heirs to contest how your estate is divided.

    05

Keeps your Thai assets separate from your foreign estate

A Thailand-specific will ensures your Thai-based assets are handled cleanly under Thai law, without waiting on probate in another country first.

    06

    Business continuity and succession

For business owners, an estate plan enables a seamless transfer of ownership, preserving company stability and protecting employees, partners, and clients.

    07

Provides for decisions if you're unable to make them yourself

A living will or lasting power of attorney means your healthcare and financial decisions are handled by someone you've chosen, not left unresolved.

    08

    Tax efficiency

Proper planning and structuring of how and when assets transfer, helps reduce that tax exposure.

Make Your Wishes Clear

Lasting Power of Attorney (LPA) in Thailand

A Power of Attorney allows you to appoint a trusted individual to manage your affairs on your behalf. In Thailand, a Power of Attorney can cover:

  • Financial Affairs: Management of property, accounts, and other assets.
  • Healthcare Decisions: Making critical medical choices on your behalf.

Setting up a Power of Attorney can offer significant reassurance, especially for those who may not have immediate family nearby.

Living Wills and Medical Directives

A living will allows you to outline your healthcare preferences should you become incapacitated and unable to communicate your wishes. Under Thai law, a living will helps ensure your healthcare decisions are respected and relieves loved ones of making these difficult choices. In a living will, you may specify:

  • Life Support: Preferences on whether to continue or withdraw life-sustaining treatment.
  • Pain Management: Guidance on palliative care, ensuring comfort during end-of-life care.

A living will offers peace of mind, ensuring your healthcare aligns with your personal values and wishes.

The Role of Executor

An executor, referred to under Thai law as an estate administrator (ผู้จัดการมรดก), is the person responsible for managing and distributing your estate after you pass away, according to the terms of your will. In Thailand, this authority isn't automatic: even if someone is named executor in a will, they generally need to be formally confirmed by the Probate Court before they can act on the estate's behalf. Naming a clear choice of executor in your will helps this process move faster than leaving the court to appoint one.

Petitioning the Probate Court

The executor applies to the Probate Court for formal confirmation of their appointment. This step is required before they have legal authority to act, and typically takes around 2 to 4 months.

Locating and Securing Assets

Identifying everything that forms part of the estate, from bank accounts and property to personal belongings, and making sure it's protected until distribution.

Settling Debts and Taxes

Outstanding debts, taxes, and other obligations are settled from the estate before any assets are distributed to beneficiaries.

Distributing Assets to Beneficiaries

Once debts and taxes are settled, the executor distributes the remaining estate according to the instructions set out in the will.

Handling Disputes

If an heir contests the will or how the estate is being handled, the executor is responsible for responding to that dispute, often with legal support.

Key considerations for expats and estate planning

wills and estate planning consultant sitting at desk
  1. Dual Jurisdiction Compliance

Laws vary by country; understanding the requirements for each can help ensure your will is valid across borders.

  2. Separate Wills for Different Jurisdictions

Many expats create one will for assets in Thailand and another for their home country, which prevents jurisdictional conflicts and simplifies probate.

  3. Tax Implications

Estate taxes can differ significantly between countries. We can guide you on structuring assets to minimize tax obligations for your beneficiaries.

  4. Choosing a Local Executor

Appointing an executor based in Thailand for Thai assets can streamline the process and help comply with local requirements.

  5. Translation and Certification

If your will is drafted in a language other than Thai, a certified translation may be needed for it to be recognized by Thai courts, ensuring clarity and legal validity.

FAQs

Do I need a separate Thai will for my Thai assets?

It's advisable. A will drafted for your home country can create complications when applied to Thai-based assets, so a Thailand-specific will helps avoid jurisdictional conflicts and simplifies probate.

Can I disinherit someone in my Thai will?

Yes. Thailand doesn't impose forced heirship, so you're generally free to leave your assets to whoever you choose. Disinheriting a statutory heir does need to be done clearly and in the correct form to hold up.

What happens if I die without a will in Thailand?

Your estate is distributed according to Thailand's statutory order of heirs, starting with descendants, then parents, then siblings, and so on. Unmarried partners, no matter how long you've been together, receive nothing under these rules.

Does my Thai will need to be in Thai?

It doesn't have to be, but if it's in another language, a certified translation is generally needed for it to be recognized by Thai courts.

Do I need to name an executor?

You don't have to, but it's strongly recommended. Naming someone in your will avoids the delays of the court appointing one for you, which can add months to settling your estate.

Does a living will cover all my healthcare decisions?

No. Its scope under Thai law is specifically about end-of-life treatment, refusing care that would only prolong a terminal illness or severe suffering. For broader medical decision-making, pairing it with a Power of Attorney is worth considering.
