Classification of Goods and Services For Trademark Registration
A trademark is a sign, word, logo, or design that identifies and distinguishes the goods or services of one business from those of another. It helps protect brand identity and ensures that consumers can recognize the source of products and services.
Trademarks are important because they provide legal protection for your brand, preventing others from using similar marks that could confuse customers. They also help build trust and reputation, allowing consumers to associate quality and reliability with your products or services. For businesses, a registered trademark can become one of the most valuable assets, strengthening market position and supporting long-term growth.
Goods Trademark
- Finished products are classified by their function or purpose. If unclear, compare with similar products in the alphabetical list or classify by raw material.
- Multi-purpose products (e.g., a watch with radio) may be classified by main function.
- Raw or semi-finished materials are classified by substance.
- Parts usable only for one product are classified with that product; multipurpose parts follow the main product principle.
- Packaging (e.g., eyeglass cases) is classified with the product it contains.
Service Trademark
- Services are classified by the nature of business activity or by comparison in the alphabetical list.
- Rental services are classified with the rented goods; leasing resembles rental, but hire-purchase is Class 36.
- Consultancy services are classified by subject matter (e.g., transport Class 39, business Class 35, finance Class 36, beauty Class 44).
- Franchise services are classified with the business type of the franchisor (e.g., legal franchise Class 45).
